I was harassed, bullied, intimidated and threatened by Michael Stanyer in July 2023 for a debt I didn't even owe. It was horrendous and I had to miss days of work because I did not feel it was safe to leave my daughter or my home alone while he was doing this. I went to the police station in Geelong and showed them the evidence of all the numbers and no caller IDs he was using and they weren't interested really. We caught him red-handed using no caller ID to continually call me even though he had denied it was him doing this to the police. we have evidence. Sometimes Stanyer is hired purely to bully and harass when a debt is not even owed. He caused me a week or more of just about the worst stress I have ever experienced. I want this disgusting man nailed.

Last Thursday , 11 July 2024, Michael John Stanyer pleaded guilty to two (rolled-up) charges at the Melbourne Magistrates Court:
ACLFTA s.45(1) – Engaging in prohibited debt collection practices; and
ACLFTA s.52(1) – Offence to charge debtor for cost of debt collection.
He was convicted and fined $15,000.

The conviction in relation to s.45(1) means that Stanyer is now a prohibited person under section 47(1) of the ACLFTA (the Act) and is prohibited for a period of 5 years from practising as a debt collector.

If Mr Stanyer continues to practice, he faces the likelihood of prosecution in relation to ACLFTA s.47(2) which is an indictable offence.

Mr Michael STANYER failed to appear at the Melbourne Magistrates Court on Wednesday 19th June, 2024. Mr Stanyer tendered a letter claiming he was too ill to attend court. This is a tact he has used previously. The court may or may not issue a Warrant for Stanyers arrest and the prosecution will amend the charges to avoid any statute limitations.

To the amusement of many, Mr Stanyer appeared quite unhinged when last appearing in court. His wrinkled blue shirt and general unkempt appearance is a far cry from the impression he portrays when he threatens and intimidates his victims. Mr Stanyer claimed he had no money, he was going to go bankrupt and that he was on suicide watch. He repeatedly gave the middle finger to the court room camera as several of his victims enjoyed the show.

Mr Stanyers next court appearance is scheduled for July 11th 2024. Case No: Q10613514. In further interesting news the media also made an application to the court to obtain copies of the charge details. Sounds like a story we might see on an A Current Affair program one night.

Debt collector Michael John Stanyer used all kinds of invective to persuade people who owed money that they should settle their bills.
He called one person “delusional”, another a “d*ckhead liar” and a “pathetic lying loser”, and labelled a couple “country bumpkins”.

Between 2021 and 2023, Stanyer aggressively pursued Victorians whose debts were referred to his firm RMS Collections by using strong-arm tactics to compel debtors who owed between $300 and $10,000 to pay businesses what they owed.

But in April 2021, nine debtors fought back, making complaints about Stanyer’s sometimes threatening calls, texts and emails to Consumer Affairs Victoria (CAV), who charged him in March this year.

Stanyer was convicted and fined $15,000 in the Melbourne Magistrates’ Court on Thursday for using unlawful collection practices and charging the debtor the cost of collections. He is also banned from debt-collection activities for five years. The court heard that one man, who owed almost $9000 and initially thought Stanyer was a scammer, was labelled a “pathetic lying loser”. Stanyer told him, “You are slightly unstable, aren’t you?” and “You lie and can’t be trusted or believed”.

He then said: “I’m going to default you first thing in the morning, so there goes your credit rating.”
He belittled another man, sending him 16 text messages in which he labelled him and his wife “country bumpkins”.

He threatened several people with default judgments, telling one man that he “will simply default your business on Monday”.
“Very easy to do it, we do it regularly and the default never goes away with the systems we use,” he said.

He also called the man “delusional”, told him to “stop wasting his time with pathetic emails and simply pay the money that is owed”, badgering him to “grow up and take responsibility and pay bills”.

He rang another man 56 times over five months pursuing a $7500 debt, swearing and threatening him over “what’s coming”.
Stanyer told The Age he works with small businesses, that his firm will close as a result of the prosecution, and he won’t contest the ban.
“The debtor who isn’t paying is protected by CAV and simply complain [sic] and then get out of paying their debt. Not really fair for us to get abused by nearly everyone we speak to and cop this treatment,” he said.

He admitted in a May hearing that he knew he should not be “yelling at people and swear at people”, and that he had begun seeing a psychiatrist and attended an anger management course, as well as going to the gym.

However, when the allegations were put to him, Stanyer remained defiant, saying he was trying to help small businesses struggling during the cost-of-living crisis, and turned his invective towards prosecutors from CAV.

“You know these guys [CAV] are looking out for the criminals and [people] not paying bills and I’m looking out for small business who are screaming desperately and closing down every day,” he told the court.

He said that collection has become difficult because debtors will use the legal system and report him to regulators when he approaches them to pay a bill.

“The latest one is people put IVOs [intervention orders] against you, so then I can’t speak to them from a debt collection point of view, this is why the country is in such a bad way, because small businesses can’t operate any more,” he said.

A Melbourne debt collector who threatened, harassed, and misled debtors has been convicted and fined $15,000 after pleading guilty in the Melbourne Magistrates’ Court.

Michael John Stanyer, 55, of Essendon was charged with engaging in prohibited debt collection practices and seeking to recover his costs under the Australian Consumer Law and Fair Trading Act 2012.

Under this law, Stanyer is also now prohibited from engaging in debt collection or running a company that engages in debt collection in Victoria for five years.

We took legal action against Stanyer and his business RMS Collections Pty Ltd (ACN 639 085 439) after receiving complaints from consumers across several states.

Stanyer used a range of prohibited methods to attempt to recover debts for his clients between June 2021 and March 2023, including using insulting language, threats and excessive contact over phone and email.

A Melbourne debt collector has unleashed a foul-mouthed tirade in court, after he was fined $15,000 and told he faces a five-year industry ban.
Michael John Stanyer was convicted in the Melbourne Magistrates' Court on Thursday for breaching consumer laws, after harassing debtors and calling them names including "d*ckhead liar" and "pathetic, lying loser".
Moments after Magistrate Tim Greenway imposed a conviction and the fine, it was revealed Stanyer would face an even worse punishment.
The court was told he faced a five-year ban from debt collecting activities.
This was because he breached sections of the Australian Consumer Law and Fair Trading Act which prohibit "undue harassment".
Debt collector Michael Stanyer told a Melbourne magistrate he would not obey a five-year ban.
The court heard it was possible for Stanyer to apply to the regulator for leniency, but he told the magistrate he would simply ignore the ban altogether.
"I'll just keep operating," Stanyer told the court.
"The world's f***ed. The whole system's screwed."
Stanyer, who made a living out of chasing people up for money owed, said he would not be paying the debt now hanging over his head.
"I'm broke. I've got no assets. I'm not paying $15,000 … I don't give a f*** anymore," he said.
"If I need to be arrested and thrown in jail for trying to make an income, happy days. That's the government for you. Thanks mate, enjoy your day."
"Thank you very much," Magistrate Greenway replied. "I don't think there's much more we can do here."
Consumer Affairs Victoria said Stanyer's offending occurred between 2021 and 2023 when he rang, texted and emailed nine debtors who each owed between $300 and $10,000.
"I'm going to default you first thing in the morning so there goes your credit rating," Stanyer told one man.
Another man who failed to pay a $7,500 fee was rung 56 times by Stanyer over five months and was threatened about "what's coming".
Debt collector claims he was defending small businesses
Stanyer was charged after several complaints were made about his conduct.
Stanyer defended his actions and said he was working for small businesses who were being ripped off by "the lowest of the low".
"They're criminals who haven't paid their debts. We're trying to collect money for the poor little businesses that are going out the back door because people are not getting paid."
In court hearings earlier this year, Stanyer said he was attending an anger management course and said his business, RMS Collections Pty Ltd, no longer employed the tactics that landed it in trouble "

Clearly Stanyer has not changing his ways. NSW Fair Trading has also advised that they will also be following suit and listed Michael STANYER as a prohibited person in NSW.

Now that Michael STANYER is a prohibited person if you have any evidence of him still conducting his business please report to Victoria Consumer Affairs, NSW fair Trading, the ACCC and email us reportmichaelstanyer @ gmail.com We will definitely pursue the matter.

Debt collecting by a person who is prohibited is an indicable offence.

On the 8th May 2024 Mr Michael STANYER formed a new identity. GALAXIE Debt Collection. The Entity name is the Trustee for RMS Collections Trust. This may or may not have been done to try and avoid pending civil litigation following from the collection practices adopted by Mr Stanyer and the charges that were preferred against him by Vic Consumer affairs. STANYER is next due in court on July 11th for sentencing.
